Case law shows that equal pay is not a sector-specific issue and can happen at every level. Utility and communications companies are just as vulnerable to claims as employers in the retail or transport industry.

 

Often pay discrimination is a systemic failing rather than an act of conscious or targeted discrimination against particular individuals. This can make it quite hard for individual employees to assess whether they have a claim or not.

 

Where there is gender segregation by job role (i.e. women tend to do one type of work, for example cleaning, and men another, for example gardening), it is easier to find a comparator to make an equal pay claim.

 

The Equality and Human Rights Commission’s gender pay gap report highlights a pay gap across all levels of seniority. It identifies nine occupational groups (listed in order of size of full-time pay gap, largest first):

 

1. Managers/Senior Officials

2. Skilled Trades (plumbers and electricians)

3. Process Plant and Machine Operatives

4. Associate Professional and Technical Groups

5. Elementary workers (cleaners, shelf fillers, packers etc),

6. Administrative and Secretarial staff

7. Personal Service

8. Professional occupations (Engineering, IT, Teachers, Accountants, Surveyors, Architects)

9. Sales and Customer Service employees
